1. About USAN Senior Retirement

USAN Senior Retirement is a daily care check-in service operated by USAN Senior Retirement Inc, 22982 Lovios, Mission Viejo, CA 92691. Our service provides automated daily phone call check-ins and reminders for older adults through an AI voice assistant named Clara.

2. Eligibility

To use our service, you must:

• Be 18 years of age or older
• Reside in the United States
• Have a valid US phone number (mobile or landline)
• Have authority to agree to these Terms on your own behalf or on behalf of the person receiving the service

3. The Service

USAN Senior Retirement provides:

• Daily automated phone call check-ins at your chosen time via our AI assistant Clara
• Medication and appointment reminders delivered by voice call
• SMS confirmations, reminders, and activity reports (with your consent)
• Weekly activity reports to designated family contacts (with their consent)
• Alert notifications to family contacts when calls are missed
• Pharmacy discount code delivery (e.g., GoodRx codes requested during calls)

The service is provided via automated telephone calls and SMS messages. Our AI assistant Clara identifies herself as an automated assistant at the beginning of every call.

4. Free Trial

New members receive a 7-day free trial of the USAN Senior Retirement service. During the trial:

• No payment is required
• You receive full access to all service features
• You may cancel at any time before the trial ends with no charge
• If you do not cancel before the trial ends, you will be offered a paid subscription plan

The trial begins on the day of enrollment and expires after 7 calendar days.

5. Subscription Plans and Pricing

After the free trial, continued access to the service requires a paid subscription. Plans are available starting from $59 per month up to $189 per month, depending on the plan selected. Plan details and current pricing are presented at the time of purchase.

Subscriptions are billed on a monthly basis. Your subscription renews automatically each month unless cancelled.

6. Payment

Payment may be made by:

• Phone — by following the automated payment prompts during a call
• Online — via a secure payment link processed through Stripe

All payments are processed securely. We do not store your full credit card number. By providing payment information, you authorize us to charge the applicable subscription fee on a recurring monthly basis until you cancel.

If a payment fails, we will attempt to contact you. Continued failure to pay may result in suspension or termination of your service.

7. Cancellation

You may cancel your subscription at any time by:

• Calling us and requesting cancellation during the call
• Sending an email to [email protected]
• Contacting us through any other method available on our website

Cancellations take effect at the end of the current billing period. We do not provide partial refunds for unused days in a billing cycle. After cancellation, you will continue to receive service until the end of the paid period.

8. SMS Communications

By enrolling in our service and providing verbal or written consent, you agree to receive automated SMS messages from USAN Senior Retirement, including:

• Service confirmations and scheduling reminders
• Pharmacy discount codes you requested during a call
• Trial and subscription notifications

Message frequency varies based on your service plan (up to 8 messages per month for enrolled members). Message and data rates may apply. You may opt out at any time by replying STOP to any message. For assistance, reply HELP.

Family contacts: SMS messages to designated family contacts are sent only after the family contact explicitly replies YES to an opt-in message. Family contacts may opt out at any time by replying STOP.

9. Not a Medical Service — Important Disclaimer

• Clara is an AI voice assistant, not a doctor, nurse, or licensed healthcare professional
• Clara does not provide medical advice, diagnosis, treatment, or clinical recommendations
• Medication reminders are provided solely as a scheduling convenience — we are not responsible for medication errors or missed doses
• In a medical emergency, call 911 immediately. Do not rely on this service for emergency assistance
• Always consult a qualified healthcare professional for any health-related decisions

10. Limitation of Liability

To the fullest extent permitted by law, USAN Senior Retirement Inc shall not be liable for:

• Any missed calls, delayed calls, or technical failures resulting from network issues, carrier outages, or circumstances beyond our control
• Any harm resulting from reliance on information provided during calls or via SMS
• Any medical outcomes, missed medications, or health incidents
• Any indirect, incidental, special, or consequential damages arising from use of the service

Our total liability to you for any claim arising from the service shall not exceed the amount you paid for the service in the 30 days prior to the claim.

11. Service Availability

We strive to provide reliable daily calls but do not guarantee uninterrupted service. Calls may be affected by:

• Telephone carrier outages or network congestion
• Technical maintenance (we will notify you in advance when possible)
• Factors outside our control (power outages, natural disasters, etc.)

We are not liable for missed calls due to circumstances beyond our reasonable control.

12. Prohibited Uses

You may not use our service to:

• Provide false information about yourself or the person receiving the service
• Enroll a person without their knowledge or against their will
• Attempt to access or tamper with our systems or data
• Violate any applicable law or regulation

13. Privacy

Your use of the service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by notice through the service. Continued use of the service after changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Orange County, California.
